1. Agreement
By creating an account, affirmatively accepting these Terms, purchasing a subscription, or using the service, the customer and its authorized users agree to these Terms. A person acting for a company represents that they are authorized to bind and act for that organization.
2. Eligibility and availability
Users must be at least 18 years old. Contractor Pursuit is initially offered only to businesses and authorized users located in the United States.
3. Accounts, users, and administrators
Each user must maintain an individual login, protect credentials, avoid unauthorized seat sharing, and report suspected unauthorized access. The customer must maintain accurate account, company-profile, licensing, certification, trade, territory, and billing information. Company administrators may manage authorized users and workspace content. Work created or uploaded within a company account remains under the company’s control when a user’s access ends.
4. Service and plan availability
Contractor Pursuit provides connected contractor workflows that may include opportunity discovery, contractor networking, business-profile discoverability, estimating, RFQs, quotes, jobs, follow-ups, financial tracking, reporting, and team workflow, depending on the subscribed plan and currently available features. The applicable plan features, limits, seats, data access, history, and entitlements are those displayed and accepted at purchase.
Plan features, limits, and pricing may be updated prospectively. Contractor Pursuit will ordinarily provide at least 60 days’ advance notice of material changes, except where faster action is needed for security, fraud prevention, legal compliance, or urgent platform risk. An already-paid subscription price will not change before its next renewal.
5. Trials, subscriptions, payment, and renewal
The limited free trial requires no payment card and does not automatically convert to a paid plan. Paid subscriptions are processed through Stripe and renew automatically for the selected monthly or annual billing period until canceled. Before purchase, the selected plan, price, billing period, renewal terms, and material limitations will be disclosed. The customer authorizes recurring charges until cancellation takes effect.
6. Cancellation and refunds
The customer may cancel before the next renewal. Unless otherwise stated at cancellation, cancellation takes effect at the end of the paid billing period and access continues through that period. Customers may use available account billing controls or contact admin@contractorpursuit.com.
Completed subscription payments are non-refundable except where required by law or expressly approved by Contractor Pursuit. Approved or legally required refunds are processed through Stripe. See the Billing Policy.
7. Customer content and permissions
The customer retains ownership of content it uploads or enters and grants Contractor Pursuit a limited, non-exclusive permission to host, copy, process, analyze, transmit, secure, and display that content as needed to operate, support, protect, and improve the service under the Privacy Policy. The customer represents that it has lawful rights and permissions for all plans, contacts, bid documents, employee information, financial records, and third-party content it supplies.
Identifiable customer content will not be used to train general-purpose AI models unless the customer separately and explicitly agrees.
8. Verification and customer responsibility
Information may come from customers, public sources, third parties, automated systems, and AI-assisted processing and may be incomplete, delayed, changed, or incorrect. The customer is responsible for reviewing authoritative sources and verifying scope, contacts, deadlines, addenda, licensing, certifications, qualifications, wage requirements, payment terms, retainage, pricing, estimates, quotes, RFQs, contracts, and final decisions.
9. Exports, cancellation, and retention
Customers should download information they wish to retain before access ends. Self-service access and downloading stop when subscription access ends. Contractor Pursuit retains an inactive company account and customer-controlled workspace information for 60 days. During that period, an authorized company representative may request one complete available export through info@contractorpursuit.com.
Exports may include available current and historical customer-controlled activity but exclude Contractor Pursuit’s proprietary future-opportunity pipeline, research database, and information outside the customer’s entitlement. Resubscription within 60 days may restore retained information. Searches and active research remain paused during inactivity and resume after reactivation and a new search or refresh. After 60 days, inactive content may be deleted or de-identified, subject to documented legal and operational exceptions.
10. Acceptable use
Users may not violate law or third-party rights; access another customer’s information; share seats or evade controls; introduce malware, scrape protected data, probe vulnerabilities, disrupt service, or unlawfully reverse engineer the platform; misrepresent identity or qualifications; harass, discriminate, defraud, spam, or conduct unlawful surveillance; or resell or republish proprietary opportunity or contractor intelligence without written permission.
11. Contractor Pursuit property
Contractor Pursuit and its licensors retain ownership of the platform, software, design, branding, research processes, matching and classification methods, proprietary opportunity intelligence, future pipeline, documentation, and other materials not owned by the customer. Subject to payment and compliance, the customer receives a limited, non-exclusive, non-transferable right to use the service for internal business purposes during the subscription period.
12. Third-party services and sources
Contractor Pursuit may rely on third-party services and information sources whose availability, terms, and content are outside its complete control. Stripe separately processes payment information under Stripe’s applicable terms and privacy practices.
13. Suspension and termination
Contractor Pursuit may restrict, suspend, or terminate access for nonpayment, security threats, fraud, unlawful activity, abuse, infringement, unauthorized access, platform interference, or material violations. Where practical and safe, notice and an opportunity to correct the issue will be provided. Immediate action may be taken when necessary for security, fraud, legal, or harm concerns.
14. Disclaimers
To the maximum extent permitted by law, the service is provided on an “as available” basis. Contractor Pursuit does not guarantee that every opportunity will be discovered, information will be complete or current, service will be uninterrupted or error-free, or use will produce awards, contracts, leads, revenue, savings, or other business outcomes. Some jurisdictions do not allow certain exclusions.
15. Limitation of liability
To the maximum extent permitted by law, Contractor Pursuit will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, or business interruption. To the maximum extent permitted by law, aggregate liability arising from the service or these Terms will not exceed subscription fees paid during the 12 months preceding the event giving rise to the claim. These limitations do not exclude liability that cannot lawfully be limited.
16. Disputes and governing law
Before filing a formal claim, the parties will provide written notice and attempt in good faith to resolve the dispute informally for 30 days, except where urgent action is appropriate for security, intellectual property, or immediate legal harm. These Terms are governed by Arizona law, without regard to conflict-of-law principles.
17. Changes to these Terms
Contractor Pursuit may update these Terms and will ordinarily provide at least 60 days’ advance notice of material changes, except where faster action is required for security, fraud prevention, legal compliance, or urgent platform risk. If a customer does not agree to a material update, it may cancel before the update or next renewal takes effect, as applicable.
18. General terms
Neither party is responsible for delay or failure caused by events beyond reasonable control, except payment obligations already due. If a provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, accepted plan terms, and any written order or addendum constitute the agreement concerning the service.
